Our store is hosted on WooCommerce. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least 18 years of age, the legal drinking age of the Republic of South Africa.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in the Republic of South Africa (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colours and images of our products that appear in real life. We cannot guarantee that your computer monitor’s display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

AGREEMENT OF SALE:

Placing an item in a shopping basket without completing the purchase cycle does not:

1. Constitute an agreement of sale between WINEWAYS and users cannot hold WINEWAYS liable if such items are not available when the purchase cycle is completed later; and/or
2. Constitute an order for such an item;
3. WINEWAYS may remove such an item from the shopping backet or wish list if no stock is available

An agreement of sale between WINEWAYS and a user only comes into effect if and when a credit card authorisation is received from the issuing bank.

WINEWAYS reserves the right to refuse to accept and/pr execute an order without giving any reasons. WINEWAYS also reserves the right to cancel orders in whole or part as circumstances dictate. WINEWAYS shall only be liable to refund monies paid.

 

STOCK AVAILABILITY:

Stocks of all goods on offer are limited. WINEWAYS shall take all reasonable efforts to discontinue the offer as soon as stock is no longer available. However, should items still be offered after stocks are sold, WINEWAYS shall only be liable to refund monies where it is unable to fulfil orders at advertised price.

 

SPECIAL OFFERS:

WINEWAYS shall not be liable for the sale of items at lower prices, if such prices were increased and users and/or purchasers could not, for any reason whatsoever, conclude an agreement of sale while such prices remained low.

If WINEWAYS supplies the wrong product or if the is in any way faulty or damaged, WINEWAYS will exchange it for the correct one. However, if the product is no longer being offered at a special price, it will not be replaced and WINEWAYS will refund the purchase price including delivery costs.

PAYMENT OPTIONS
Payment may be made via Visa, MasterCard or by bank transfer into the WINEWAYS bank account, the details of which will be provided on request.

CARD ACQUIRING AND SECURITY
Card transactions will be acquired for WINEWAYS via PayFast (Pty) Ltd who are the approved payment gateway for all South African
Acquiring Banks. DPO PayFast uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the
website. Users may go to www.PayFast.co.za to view their security certificate and security policy.

CUSTOMER DETAILS SEPARATE FROM CARD DETAILS
Customer details will be stored by WINEWAYS separately from card details which are entered by the client on DPO PayFast’s secure site.

MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

RESPONSIBILITY
WINEWAYS takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

COUNTRY OF DOMICILE
This website is governed by the laws of South Africa and WINEWAYS chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
